ACCURACY OF HOTEL INFORMATION

Air Canada Vacations uses a third party content provider to provide some enriched hotel information. We make every effort to ensure that the hotel information described online is current and accurate and updates are posted on our website when new information is made available. However Air Canada Vacations cannot be responsible for any inaccuracies or omissions contained herein. Hotel information contained herein is provided as a guideline only and should be verified directly with other available sources.

Credit Card Payments

Your use of your credit card number to apply final payment indicates your acceptance of and compliance with these booking Terms & Conditions, whether or not you have actually signed the appropriate credit card slip. Insurance

Air Canada Vacations strongly recommends the purchase of an all-inclusive holiday insurance package (trip cancellation & interruption & classic travel insurance) offered by RBC Insurance or other sufficient traveller's insurance. Government health plans have severely cut back their coverage of

TERMS & CONDITIONS OF PAYMENT, CHANGES AND CANCELATION FEES FOR BOOKING AIR & HOTEL, AIR ONLY OR LAND ONLY PACKAGES:

Deposit, Final Payment & Cancellation charges “Payment schedule”

Full payment must be paid by credit card at time of booking. Air Canada Vacations reserves the right to cancel your booking if full payment is not received by the scheduled due date. Unless you or your travel agent is notified in writing that your booking has been automatically cancelled due to insufficient payment, your booking remains confirmed and full payment is due as per Air Canada Vacations' payment schedule outlined above.

Change Fees

Once final payment is received any changes or modifications to a file will incur an administration fee of $50. In addition to this fee, any changes or modification will be subject to all airline and supplier penalties and fees. Change fees of 100% of the total price of your booking will be applied if change is made within 7 days of departure. In addition, you assume responsibility for any such difference in price. Refunds will not be issued for any difference on a lower price alternative. If the change is made to room occupancy and results in a higher rate, the remaining travellers are responsible for the rate applicable for the revised occupancy. Change requests cannot be made directly with any hotel / resort, land operator or cruise company. Name change requests may be denied due to hotel, airline and / or cruise specific terms and conditions. Dates changes to a reservation will result in a cancellation with all applicable fees.

CANCELLATION FEES

Cancellation fees will apply as outlined below:

Refunds for cancellation of a reservation will only be taken into consideration once notice is received in writing at Air Canada Vacations.

Standard Cancellation Policy:

Air and hotel or Air only packages or hotel only packages. Excursions / day tours if applicable:
• 45 days or more prior to departure: $500 per person or 100% of total cost if value less than $500 per person
• 44- 22 days prior to departure: 50% of total price or 100% of total cost if value less than $500 per person
• 21-0 days prior to departure: 100% of total price**.

Cancellation fees are liquidated damages to compensate

Air Canada Vacations for prepayments made on advance booking of travel services, and for administrative costs involved in processing a cancellation

TRAVEL DOCUMENTS

Air Canada Vacations uses electronic ticketing. Receipt of payment / booking confirmation is issued once payment has been received. Upon receipt of full payment and all applicable fees, electronic tickets will be issued between 30 and 14 days prior to departure. For reservations made 7 days or LESS prior to departure, electronic tickets will be made available within 24 to 48 hours.

OTHER TERMS & CONDITIONS FOR ANY BOOKING:

Refunds

No reimbursements or refunds will be issued for unused travel services or any component of the package after departure. Refunds are not granted for bookings cancelled due to inclement weather or illness; these must be claimed through your travel insurance. No guarantee is provided or warranted that any refund will be available. No refunds will be granted if a sale price is advertised after a reservation is confirmed.

Important: If the price of a product is displayed incorrectly at aircanadavacations.com, we reserve the right to cancel the reservation at the incorrect price within a reasonable delay and a refund of the monies will be processed immediately.

Reporting of Incidents

Regardless of Air Canada Vacations liability, any incidents including injuries, service cancellation or problem, or dissatisfaction must be reported to Customer Care (telephone number with travel documents) during the event or as soon as possible to allow Air Canada Vacations an opportunity to provide assistance. -If you are on a cruise, please report to the Purser's Office while you are on board, they will make every effort to resolve it.

GENERAL

Validity of Rates

Prices displayed in this site are the lowest available at time of posting, and apply to a specific date. Air Canada Vacations endeavours to deliver the vacation package you have selected. If the price increased following the imposition of a surcharge on fuel by the carrier or an increase in the exchange rate, insofar as the exchange rate before the date on which the services are provided has increased by more than 5% since the date on which the contract was entered into; and / or if the increase, without taking into account any increase in the Québec sales tax or Canada's goods and services tax, is equal to or greater than 7% of the price of services, the customer may choose between full and immediate reimbursement of the services or the provision of similar services; Refunds are processed by Air Canada Vacations within 14 days of receipt of your written request for cancellation.

Currency

All rates are quoted in Canadian funds, unless otherwise indicated based on exchange rates, fuel cost, taxes, fees, charges and surcharges (including services charges imposed by Air Canada Vacations) valid at time of posting.

INCLUSIONS AND EXCLUSIONS

Prices DO Include

Selected combination of flights, accommodation, transfers at destination when applicable, applicable taxes, fees, charges and surcharges (including services charges imposed by Air Canada Vacations) and any other inclusions as specified for product selected as per the description in this site aircanadavacations.com.

Prices DO NOT Include

Most holiday packages are subject to extra charges above those reflected in the price listed for each package. For example, any supplementary services purchased at destination (meals, drinks, cleaning, items listed in the facility description etc.) in addition to any costs incurred en route to and / or from the destination, meals and / or alcoholic beverages (unless specified), local excursions at destination, telephone calls, tips, laundry, items of a personal nature and / or personal services not specified as being included in association with a selected product as per the resort description on aircanadavacations.com, are not included in Air Canada Vacations package prices. For Quebec residents only, prices do not include the client contribution to the Indemnity Fund amounting to $1.00 per $1000 of travel services purchased, the amount of which will be added to the client's invoice.

If We Modify Your Booking

Sometimes, reserved accommodations may no longer available for reasons such as unexpected maintenance or hotel overbooking. In such cases, substitute accommodation of equal or greater quality will be provided. If, after confirmation, a hotel change or other changes to your travel arrangements such as:
• change of destination;
• change of departure or return by more than 16 hours;
• change of accommodation standards;
• change of the routing requiring additional travel identification or documentation without sufficient time to obtain this documentation before departure.
Then Air Canada Vacations will contact you or your travel agent at the earliest convenience upon receipt of notification from the concerned supplier prior to your departure. In this case, Air Canada Vacations offers the following options:
   a. Acceptance of the change as offered;
   b. Selection of an alternate package with Air Canada Vacations, based on availability. Any price differential resulting from substitution with a lower-priced alternative will be refunded. Customers are responsible for payment of any difference in price based on substitution of a higher-priced alternative of their choice;
   c. Cancellation of your vacation with a full refund of price paid to Air Canada Vacations

HOTEL/SHIP DESCRIPTION

All descriptions in this site are accurate at time of posting. For reasons beyond Air Canada Vacations' control, changes which may affect hotels' or cruises' or tours' description may occur. Any modification will be updated on Air Canada Vacations' website and will be communicated at time of booking.

LIABILITY

Liability of Suppliers

Air Canada Vacations makes arrangements with third-party suppliers who provide travel services such as flights, cruises, hotels, airport-hotel transfers, sightseeing, car rental or other activities included in your package. Air Canada Vacations makes every effort to deal with the most reputable suppliers; we are not responsible for their acts and omissions and for acts and omissions of their respective employees, representatives or agents. Travel services are subject to conditions imposed by law and by third-party suppliers. As such, their liability is limited by their respective tariffs, conditions of carriage as well as international conventions and arrangements. Conditions of Carriage apply to flights bound to and from your destination, some of which limit or exclude liability. For air carrier liability and options available to you regarding loss, damage or delay of your baggage, consult aircanada.com and submit any claims directly to Air Canada. Air Canada Vacations does not assume any responsibility for schedule changes made by the airline, or any additional costs (accommodation, meals, etc.) incurred due to any flight delays or missed connections. Additional hotelier terms and conditions may also apply.

Liability of Air Canada Vacations

Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising out of personal injury, accident or death, loss, damage, delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any of the following:
• The act of omission of any third party including suppliers other than Air Canada Vacations or its employees;
• Sickness, theft, labour dispute, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control;
• Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you are not entitled to any refund);
• Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in / checkout times;
• Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or substitute travel services with a comparable alternative at our discretion and Air Canada Vacations will advise you within a reasonable amount of time prior to your departure of any such a cancelation or change. If we must cancel your booking entirely, Air Canada Vacations' liability will be limited to a refund of all monies paid.
• A full refund, however, will not be granted where cancellation of travel must be made by Air Canada Vacations for any situations which are unusual and / or unforeseeable, i.e., any force majeure including (but not limited to) weather conditions such as inundation, any type of storm, hurricane, twister or similar, fire, seismic activity, nuclear disasters, strikes, riots or civil conflicts, acts of war, terrorist actions, any public health emergencies or health risks, government actions, supplier bankruptcies and any other events beyond Air Canada Vacations control Air Canada Vacations is not liable for the costs or other consequences that arise out of or result from any inclement weather conditions at any time and where Air Canada Vacations' contractual obligations with its suppliers does not allow for reimbursement of the sums paid to the supplier on behalf of the customer.
All flights from and to Canada are operated by Air Canada and its Star Alliance partners or Air Canada Express (operated by Jazz Aviation LP), unless otherwise specified. Pending on the countries visited and named in this site, flights can be operated by Air New Zealand, Singapore Airlines, Asiana, Air Tahiti Nui, Thai Airways, LAN, TAM, Vietnam Airlines, China Eastern, Virgin Blue, Qantas Airways, Aerolineas Argentina, Avianca-Taca, Air Tahiti, Air China, Korean Airlines or Cathay Pacific
The carrier will be communicated before making your reservation and the payment.
Photographs displayed in this site are representational only, and not a guarantee that everything is exactly as depicted upon arrival at destination.
For hotels or ships that are indicated as being ‘projects', Air Canada Vacations assumes no liability whatsoever as to any difference between the artist rendition or the listed features or description and the actual state of the hotel or ship at the time of booking. Air Canada Vacations will do its best to monitor the construction and readiness; it does not have control over this. Please consult aircanadavacations.com as to the update of the hotel.
Living standards and practices at the destination and the standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those found in Canada.

Baggage claims

Please note that for baggage claims: written notice to the carrier must be made within 7 days of the receipt of checked baggage in the case of damage, and, in the case of delay, within 21 days from the date on which it was placed at the disposal of the passenger.

Failure to have proper travel documents will result in denied boarding and automatic cancellation of your reservation without refund. Electronic Ticketing

Air Canada Vacations uses electronic ticketing for the air/flight portion of your itinerary. Receipt of payment/booking confirmation is issued once payment has been received. Upon receipt of full payment and all applicable fees, electronic tickets will be issued between 30 and 14 days prior to departure. For reservations made 7 days or LESS prior to departure, electronic tickets will be made available within 24 to 48 hours. For reservations made on the day before departure, your travel documents will be issued within an hour of booking.

Change Fees

If you wish to make a change to a confirmed booking,the following charges will apply:
• 21 days or more prior to departure date: $100 per person plus applicable taxes. Accommodation and flight penalties may apply, as per exceptions below
• 20 days or less prior to departure: 100% non-refundable.

In addition, you assume responsibility for any such difference in price. Refunds will not be issued for any difference on a lower price alternative. If the change is made to room occupancy and results in a higher rate, the remaining travellers are responsible for the additional rate applicable for the revised occupancy. Change requests cannot be made directly with any hotel or resort. Name change requests may be denied due to hotel- or airline-specific terms and conditions. Changes made 6 days or LESS prior to departure are not accepted. Any changes, including name changes or corrections, you wish to make to a confirmed booking 7 days or LESS prior to departure will be treated as a cancellation. Cancellation fees will apply as outlined below. Refunds for cancellation of a reservation will only be taken into consideration once notice is received in writing by Air Canada Vacations.

• 90 days or more prior to departure: $500 per person plus applicable taxes.

Orca Whales and Grizzly Bears:
• 61 days or more prior to departure: $500 per person plus applicable taxes.
• 60 days or less prior to departure: 100% non-refundable

Ski Vacations

• 21 days or less prior to departure: 100% non-refundable

Guided Tours

Atlantic Maritimes; Enchanting Islands; Circle the Bay of Fundy:
• 31 days or more prior to departure: $500 per person plus applicable taxes.
• 30 days or less prior to departure: 100% non-refundable
Best of the Canadian Rockies; Beaches and Glaciers:
• 61 days or more prior to departure: $500 per person plus applicable taxes.
• 60 to 31 days prior to departure: 50% per booking/per cancelled product.
• 30 days or less prior to departure: 100% non-refundable
Vancouver Island Camping Adventure:
• 36 days or more prior to departure: $500 per person plus applicable taxes.
• 35 days or less prior to departure: 100% non-refundable
All Theatre/Show Tickets, Day Tours And Theme Park Tickets
• Any time after booking: No changes permitted

NOTE: The nature of some excursions or tours or package components may involve a significant amount of personal risk. Air Canada Vacations assumes no responsibility arising from any damages or injuries or death resulting from these inherent risks.

Fly & Drive:

Conditions of car rental included with Fly & Drive:

Daily rate is based on 24 hours.

Clients will be charged directly for additional hours, days and any additional coverage or optional products purchased at the commencement of the rental.

Minimum rental period is 48 hours.

Rates are based on the pick-up date, and not the return date.

An honoured credit card may be required at time of checkout for any other charges not included in the voucher, e.g. gasoline, Loss Damage Waiver, Personal Accident Insurance, one way service fees and taxes.

Minimum age for car rental is 21 with a prepaid voucher. A valid driver's license from country of origin must be presented at time of rental. All drivers under the age of 25 will be subject to a surcharge of CA$25.00 per day; subject to change

Certain car classes may not be available to drivers under age 25.

Certain locations and classes of car require 3 forms of identification as a condition to rent.

Additional authorized drivers - including spouses and partners - must be registered on the rental agreement. Additional driver fee is CA$10.00 per day per additional driver up to a max of CA$50.00 per rental, per driver, where applicable; subject to change. All additional drivers should hold an honoured charge card and must possess a valid driver's license.

One-way rentals are available and are subject to applicable one-way service fees. One-way rentals are subject to availability. One-way fees are determined by distance between stations.

Guaranteed drop charges are paid locally by clients directly. This charge will be held against the customer's credit card but will not be charged to the card until the completion of the rental. These charges are subject to applicable taxes and surcharges.

One-way rentals into the US are not allowed.

Vehicles can be driven into the USA but not Mexico. This may vary by location, where applicable.

Vehicles come with a full tank of gas at time of rental.

Rates do not include fuel unless specifically indicated.

The renter is responsible for refuelling at the end of the rental if the Fuel Purchase Option is not purchased by the client at time of rental or included in the net rates. Gasoline refueling charges will vary by region and fluctuate according to market conditions dictating the cost of fuel.

There is no credit for remaining fuel.

Some optional products, such as child seat, skierized vehicle, garmin GPS, unit, may be available at a fee.

Insurance

Air Canada Vacations strongly recommends the purchase of an all-inclusive holiday insurance package (trip cancellation & interruption & classic medical travel insurance) offered by RBC Insurance or other sufficient traveller's insurance. Government health plans have severely cut back their coverage of out-of-country medical care. When travelling to Cuba, all travellers, foreign and Cubans living abroad, must have a medical insurance policy.

Reimbursements are processed by Air Canada Vacations within 14 days of receipt of your written request for cancellation.

Prices DO NOT Include:
Most holiday packages are subject to extra charges above those reflected in the price for each package. For example, any supplementary services purchased at destination (meals, drinks, cleaning, items listed in the facilities description etc.) in addition to any costs incurred en route to and/or from the destination, meals and/or alcoholic beverages (unless specified), local excursions at destination, telephone calls, tips, laundry, car rental insurances and taxes and fees billed at destination by the car rental company when booking a car rental, items of a personal nature and/or personal services not specified as being included in association with a selected product as per the resort description in this site at aircanadavacations.com, are not included in Air Canada Vacations package prices.

For Quebec residents only: Prices do not include the client contribution to the Indemnity Fund amounting to $1.00 per $1000 of travel services purchased, the amount of which will be added to the client’s invoice.

If We Modify Your Booking

Sometimes, reserved accommodations may no longer be available for reasons such as unexpected maintenance or hotel overbooking. In such cases, substitute accommodation of equal or greater quality will be provided. If, after confirmation, Air Canada Vacations makes a hotel change or other changes to your travel arrangements such as:
• change of destination;
• change of departure or return by more than 24 hours;
• change of accommodation standards;
• change of the routing requiring additional travel identification or documentation without sufficient time to obtain this documentation before departure;

then Air Canada Vacations will contact you or your travel agent at the earliest convenience upon receipt of notification from the concerned supplier prior to your departure. In this case, Air Canada Vacations offers the following options:
a. Acceptance of the change as offered;
b. Selection of an alternate package with Air Canada Vacations, based on availability. Any price differential resulting from substitution with a lower-priced alternative will be refunded. Customers are responsible for payment of any difference in price based on substitution of a higher priced alternative of their choice;
c. Cancellation of your vacation with a full refund of the price paid to Air Canada Vacations.

HOTEL DESCRIPTIONS

All hotel descriptions in this site are accurate at time of posting. For reasons beyond Air Canada Vacations' control, changes that affect hotel descriptions may occur. Any modification will be updated on aircanadavacations.com, and will be communicated at time of booking. In the event of any discrepancy between information in the brochure and our website, the information on our website shall prevail.

LIABILITY

Liability of Suppliers

Air Canada Vacations makes arrangements with third-party suppliers who provide travel services such as flights, cruises, hotels, airport-hotel transfers, sightseeing excursions, car rentals or other activities included in your package.

Air Canada Vacations makes every effort to deal with the most reputable suppliers; we are not responsible for their acts and omissions and for acts and omissions of their respective employees, representatives or agents.

Excursions

Customers may choose to participate in excursions, optional tours or activities that may be offered for an additional fee by Air Canada Vacations on behalf of local suppliers at destinations. Any written or oral contract is considered to be exclusively between the customer and the supplier. Some excursions may have a risk of personal injury, loss or damage. Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising from a customer's participation in said excursions.

Airline

Travel services are subject to conditions imposed by law and by third-party suppliers. As such, their liability is limited by their respective tariffs, conditions of carriage as well as international conventions and arrangements. Conditions of Carriage apply to flights bound to and from your destination, some of which limit or exclude liability. For air carrier liability and options available to you regarding loss, damage or delay of your baggage, please consult the Air Canada website and submit any claims directly to Air Canada. Air Canada Vacations does not assume any responsibility for schedule changes made by the airline, or any additional costs (accommodation, meals, etc.) incurred due to any flight delays or missed connections.

Liability of Air Canada Vacations

Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising out of personal injury, accident or death, loss, damage, delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any of the following:
• The act or omission of any third party including suppliers other than Air Canada Vacations or its employees;
• Sickness, theft, labour dispute, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control;
• Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you are not entitled to any refund);
• Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in/check-out times;
• Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or substitute travel services with a comparable alternative at our discretion, and Air Canada Vacations will advise you within a reasonable amount of time prior to departure of any such cancellation or change. If we must cancel your booking entirely, Air Canada Vacations' liability will be limited to a refund of all monies paid;
• A full refund, however, will not be granted where cancellation of travel must be made by Air Canada Vacations for any situations which are unusual and/or unforeseeable, i.e., any force majeure, including but not limited to, weather conditions such as inundation, any type of storm, hurricane, tornado or similar, fire, seismic activity, nuclear disasters, strikes, riots or civil conflicts, acts of war, terrorist actions, any public health emergencies or health risks, government actions, supplier bankruptcies and any other events beyond Air Canada Vacations' control.

Hurricane season in the North Atlantic is generally between June 1 and November 30. Air Canada Vacations is not liable for the costs or other consequences that arise out of or result from any inclement weather conditions at any time and where Air Canada Vacations' contractual obligations with its suppliers does not allow for reimbursement of the sums paid to the supplier on behalf of the customer.

All flights are operated by Air Canada, Air Canada Rouge or Air Canada Express (operated by either Jazz Aviation LP, Sky Regional, Air Georgian or EVAS-Exploits Valley Services), unless otherwise specified.

Air Canada Vacations reserves the right to decline any passenger at any time.

OTHER IMPORTANT INFORMATION

Airport Check-in

It is recommended that customers present themselves at the airport counter of the airline indicated on their voucher 3 hours prior to departure, and must follow the check-in and boarding gate deadlines listed on the Air Canada website.

Air Canada representatives are available to assist you while at the airport, or you may contact an Air Canada Vacations representative at 1-800-296-3408. Failure to check-in and board on time may result in the cancellation of a customer's reservation with no right of recourse or refund.

Minors - Flight Portion

Infants under 2 years of age (at date of completion of travel) travel for a reduced rate aboard Air Canada. Only one infant is permitted per adult passenger (16 years of age or older). Reduced rates are also available for children between 2 and 12 years old.

Food, Water and Beverages

Change of routine, sun and/or food, water and beverages may be very different in other countries and may lead to health issues or illness. Customers are encouraged to take all necessary precautions. Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising from these conditions and resulting health issues. Water interruptions/power outages may be experienced at times.

Social and Sports Activities

Many resorts include social activities, organized sports, and use of sports equipment as part of their services. These amenities are subject to change or cancellation at any time without notice. Some activities may involve risks.

Insects

Insects may be found inside and outside of the hotel no matter the hotel chosen as part of the vacation package. Customers are encouraged to take all necessary precautions.

Holidays, School Breaks, Elections and Conventions

Availability of some services and amenities may be limited during certain periods. These periods may include but are not limited to school breaks, spring breaks, religious holidays, elections and conventions. These periods vary by country and are controlled by local or particular authorities.

Air Canada Vacations assumes no responsibility for inconveniences customers may experience when travelling during one of these periods.

Hotel/Room Allocation

The hotel or resort is responsible for room allocation in accordance with the category reserved. Air Canada Vacations assumes no responsibility as to the location, décor, furnishing or type of bed in the room that may vary based on the room's location on the hotel property. If the customer would like to change rooms, such changes are subject to availability and additional fees may apply.

For all "Go Canada" travel packages, in addition to the above, the stipulation of "or similar" indicates that guests will stay at a hotel of the same star rating as the hotel listed. The hotel accommodations will be communicated to the consumer prior to departure.

Check-in and Check-out Conditions

Hotel check-in is generally between noon and 3 p.m. Hotel check-out times may vary depending on the property but generally customers must vacate the room by 11 a.m. For passengers with late flights, every effort will be made to provide a hospitality room, however, this cannot be guaranteed, particularly during high season.

Luggage

You can take one carry-on bag and one personal item on the flight.

Transfers

Travel times from the airport to your hotel in this site are approximate and can vary due to unforeseen circumstances.

CUSTOMER RESPONSIBILITY

Special Needs

Any particular requirements for passengers with special needs must be requested at time of booking. Some circumstances and medical conditions require that customers provide advance notice and receive medical approval for air travel (for more information, visit the Air Canada website). Adapted transport for transfer at destination is at extra cost when available. Certain activities at the hotels may be inaccessible to persons of reduced mobility.

Statement to the Travel Agent

Customers must inform their travel agents of their intentions, expectations and needs before their travel reservations are completed.

Medication

It is the customer's responsibility to have all necessary medications and to carry them in their hand luggage at all times and to refer to the Air Canada website for required policy to transport prescribed medication. It is the customer's responsibility to ensure that they are fit to travel, and that they have consulted a qualified medical professional.

Pregnancy

You are required to disclose pregnancy to Air Canada Vacations at time of booking. Any woman with a normal pregnancy and no previous history of premature labour may travel up to and including her 36th week on Air Canada , Air Canada Express (operated by Jazz Aviation LP, Sky Regional, Air Georgian or EVAS-Exploits Valley Services) or Air Canada Rouge.

Credit Card Payments
Your use of your credit card number to apply deposit and final payment indicates your acceptance of and compliance with these booking Terms & Conditions, whether or not you have actually signed the appropriate credit card slip. Verbal authorization for the use of a credit card confirms the reservation.
Air Canada Vacations reserves the right to cancel your booking if full payment is not received by the scheduled due date. Travel Documents
It is the passengers' responsibility to obtain information and to have in their possession all the required documentation to travel (such as passports, visas where applicable, etc.) required by the relevant governmental authorities. Failure to have proper travel documents will result in denied boarding and automatic cancellation of your cruise package without refund.

Electronic Ticketing
Air Canada Vacations uses electronic ticketing for air, land and cruise arrangements. Receipt of payment/booking confirmation is issued once payment has been received. Upon receipt of full payment and all applicable fees, electronic tickets will be issued between 30 and 14 days prior to departure. For reservations made 7 days or LESS prior to departure, e-tickets will be made available within 24 to 48 hours. For reservations made on the day before departure, your travel documents will be issued within an hour of booking.

Insurance
Air Canada Vacations strongly recommends the purchase of an all-inclusive holiday insurance package (trip cancellation & interruption & classic medical travel insurance) offered by RBC Insurance or other sufficient traveller's insurance. Government health plans have severely cut back their coverage of out-of-country medical care.

Arrive prior to sailing: It is recommended that you arrive at destination one day prior to the first sailing date. To select a hotel, see aircanadavacations.com.

Change Fees: If you wish to make any changes to your confirmed booking before the cancellation period begins, as per Air Canada Vacations' payment schedule outlined above, Air Canada Vacations will endeavour to make every reasonable effort to accommodate your request. All changes are subject to availability. Change fees may apply depending on the nature of the change and date of your request. Details vary by cruise line, and are available at time of request.

Note: Any changes that you wish to make to a confirmed booking within the cancellation period set by the relevant cruise line will be treated as a cancellation. Cancellation fees are applicable as outlined above. If a cancellation is made by one or more passengers impacting stateroom occupancy, remaining passengers are responsible for full payment of applicable revised rate for accommodation.

Cancellation Charges: If you must cancel your cruise holiday, cancellation fees will apply depending on cruise booked and when you advise us of the cancellation, as per Air Canada Vacations' payment schedule outlined above. These charges are per person and apply to each guest in the stateroom. In the event that charges are based on a percentage, please note it is a percentage of the total price including all taxes and other fees (service charges included). In addition to these charges, cancellation fees apply to any flight, transfer, hotel or tour booked in conjunction with your cruise. Details are available at time of booking. No-show at time of sailing regardless of reason is 100% non-refundable.

The cancellation policy set out in Air Canada Vacations' payment schedule outlined above is based on information provided by each individual cruise line, and is subject to change without prior notice. Cancellation fees are, notably, liquidated damages to compensate Air Canada Vacations or prepayments made on advance booking of travel services, and for administrative costs involved in the processing of a cancellation.

Aeroplan® Miles cannot be restituted or refunded at any time.

Flight Guarantee:
Air & Cruise must be booked together with Air Canada Vacations. Flights will be rebooked depending on the next available flight aboard Air Canada or Air Canada rouge, subject to availability. No refund will be given for missed days of cruise. The Flight Guarantee is not applicable to Force Majeure situations or for other reasons beyond the control of the air carrier. Hotel accommodations and any related land expenses associated with the delay are the sole responsibility of the client. The Flight Guarantee does not replace travel insurance. The Flight Guarantee may be discontinued or changed at any time without notice. Other conditions may apply and are available at the time of booking.

Best Price Guarantee:
Our Best Price Guarantee applies to the base price for the cruise and will not apply to any government fees, non commissionable fees and taxes and/or any fuel supplement charge. Lower rates must be publicly advertised rates available to the general public and advertised on the official web sites of each or any of the cruise line companies. The lower rate must: i) be for the same ship, sail date, stateroom category and number of guests; and ii) be available for reserving at the time Air Canada Vacations reviews your submitted Best Price Guarantee claim. The Best Price Guarantee may be discontinued or changed at any time without notice. The Best Price Guarantee is applicable to Canadian reservations only.

Cruise Line Passenger/Embarkation Form
In order to simplify the boarding process and to comply with international security laws, all travellers are required to complete a passenger immigration/embarkation form, found on each cruise lines' web site well in advance of your sailing date. Travellers that do not complete the registration process at least seven (7) days prior to sail date will be required to be checked-in at the pier at least two (2) hours prior to the published sailing time or they will be subject to denied boarding with no refund. In addition, failure to properly complete the on-line registration form in a timely manner will result in delayed cruise electronic documents.

Vaccinations
Passengers are solely responsible for obtaining all required medical inoculations and appropriate certificates necessary for travel.

Minors
All cruise lines require individuals under the age of 21 to be accompanied by an adult of at least 21 years of age (ages 25+ for CCL). This requirement is waived for married couples (proof of marriage is required) and minor children sailing with their parents or guardians in adjacent staterooms. The age of each individual on the date of sailing determines his/her status for the entire cruise. Age restrictions for alcohol consumption and gambling as well as infant and child rates and infant age restrictions vary by cruise line. Age requirements are subject to change. Please confirm at time of booking. Generally infants under six (6) months of age are not permitted to sail.

Special Needs
Any particular requirements (stateroom, airline and/or transfers) for passengers with special needs must be requested at time of booking. Most cruise lines have limited wheelchair-accessible staterooms for which a medical certificate is required to book. Passengers MUST provide this certificate to the cruise line at least 30 days BEFORE scheduled sailing. Any special transfer arrangements required may incur additional charges. Cruise passengers with special needs must be self-sufficient and accompanied by at least one other passenger who assumes full responsibility for their well-being at all times. Passengers are advised to consult with an Air Canada Vacations cruise expert regarding the feasibility of managing certain itineraries. In certain cases, passengers in wheelchairs may be precluded from going ashore due to docking facilities. Please ensure your Air Canada Vacations cruise expert verifies all details concerning guests with physical challenges as cruise line policies are subject to change without prior notice.

Pregnancy
Pregnancy is considered a medical condition and you are required to disclose this to Air Canada Vacations at time of booking. Women having reached the late stage of their pregnancy (generally 24 weeks pregnant) will not be permitted to sail. A medical certificate may be required for women in their 23rd week or earlier who choose to sail. Details vary by cruise line and are always subject to change. Cruise line-specific details will be provided at time of booking once we are notified of your condition.

Unfit for travel
Air Canada Vacations and its cruise line partners reserve the right to decline any passenger at any time. Passengers may be declined or have their voyage terminated at their own risk and expense should their physical or mental condition, in the opinion of the ship's physician, render them unfit for travel, or represent a danger to themselves or any other passenger aboard the ship. Cruise lines also reserve the right to decline or terminate the voyage of any passenger who, at the sole discretion of the ship's captain, is believed to be dangerous to him/herself or others, or a cause of disturbance to cruise passengers or crew. Such passengers may be left at any scheduled port of call or place without any liability to the cruise line or Air Canada Vacations. In this circumstance, no refund or extra expenses will be honoured by the cruise line or Air Canada Vacations.

CRUISE TRAVEL DOCUMENTS

Travel documents for cruise booking: cruise electronic documents are issued between 21 and 14 days prior to departure. It is the full responsibility of all nationalities to obtain at their own expense, well in advance of the departure date, all necessary travel documents required by the relevant government authorities, including all the different ports of call, and to comply with the laws, thereof. Passports are required for Canadians travelling by air or by sea and the passport MUST be valid for six (6) months beyond the end date of your travel abroad. Failure to have the proper travel documents will result in denied boarding and automatic cancellation of your cruise package without refund. Some cruise itineraries require a travel visa in addition to a passport if you intend to disembark the ship on your own, without participating in an organized shore excursion purchased from the cruise lines.

Note: Single parents must travel with a notarized letter of consent signed by the parent not travelling for presentation to the airline/cruise line without which the airline and/or cruise line reserve the right to deny boarding.

Fuel supplements: All cruise lines reserve the right to impose a fuel surcharge if the NYMEX oil price exceeds certain limits during the year.

Dining: Requests for specific dining times and table size will be accepted at the time of booking but cannot be guaranteed or confirmed prior to departure and Air Canada Vacations will not be held responsible if such requests cannot be fulfilled.

Refunds: No reimbursements or refunds will be issued for unused travel services or any component of the package after departure. Refunds are not granted for bookings cancelled due to inclement weather or illness; these must be claimed through your travel insurance. No guarantee is provided or warranted that any refund will be available. No refunds will be granted if a sale price is advertised after a reservation is confirmed.

Important: If the price of a product is displayed incorrectly at aircanadavacations.com, we reserve the right to cancel the reservation at the incorrect price within 24 hours of the booking being made and a refund of the monies will be processed immediately.

Reporting of incidents
Regardless of Air Canada Vacations liability, any incidents including injuries, service cancellation or problem, or dissatisfaction must be reported to Customer Care (telephone number and/or email with travel documents) during the event or as soon as possible to allow Air Canada Vacations an opportunity to provide assistance. If you are on a cruise, please report to the Purser's Office while you are on board; they will make every effort to resolve it.

Validity of rates in this website
Prices displayed are the lowest available at time of posting, and apply to a specific date and category. Prices are subject to change and have limited availability. Air Canada Vacations endeavours to deliver the vacation package you have selected. If the price increased following the imposition of a surcharge on fuel by the carrier or an increase in the exchange rate, insofar as the exchange rate applicable 45 days before the date on which the services are provided has increased by more than 5% since the date on which the contract was entered into; and/or if the increase, without taking into account any increase in the provincial sales tax or Canada's goods and services tax, rising taxes, royalties or authorized charges by a competent public authority is equal to or greater than 7% of the price of services, the customer may choose between full and immediate reimbursement of the services or the provision of similar services. Refunds are processed by Air Canada Vacations within 14 days of receipt of your written request for cancellation.

For example, any supplementary services purchased at destination (meals, drinks, cleaning, etc.) in addition to any costs incurred en route to and/or from the destination, meals and/or alcoholic beverages (unless specified), local excursions at destination, telephone calls, tips/gratuities, laundry, items of a personal nature and/or personal services not specified as being included in association with a selected product as per the product description in this website aircanadavacations.com, are not included in Air Canada Vacations package prices.

For Quebec residents only: prices do not include the client contribution to the Indemnity Fund amounting to $1.00 per $1000 of travel services purchased.

If We Modify Your Booking
Sometimes, reserved accommodations may no longer be available for reasons such as unexpected maintenance or hotel/ship overbooking. In such cases, substitute accommodation of equal or greater quality will be provided. If, after confirmation, Air Canada Vacations makes a hotel /ship change or other changes to your travel arrangements such as:

  • change of destination;
  • change of departure or return by more than 16 hours;
  • change of accommodation standards;
  • change of the routing requiring additional travel identification or documentation without sufficient time to obtain this documentation before departure; then Air Canada Vacations will contact you or your travel agent at the earliest convenience upon receipt of notification from the concerned supplier prior to your departure. In this case, Air Canada Vacations offers the following options:
    1. Acceptance of the change as offered;
    2. Selection of an alternate package with Air Canada Vacations, based on availability. Any price differential resulting from substitution with a lower-priced alternative will be refunded. Customers are responsible for payment of any difference in price based on substitution of a higher priced alternative of their choice;
    3. Cancellation of your vacation with a full refund of price paid to Air Canada Vacations.

Air Canada Vacations makes every effort to deal with the most reputable suppliers, we are not responsible for their acts and omissions and for acts and omissions of their respective employees, representatives or agents. Travel services are subject to conditions imposed by law and by third-party suppliers. As such, their liability is limited by their respective tariffs, conditions of carriage as well as international conventions and arrangements. Conditions of Carriage apply to flights bound to and from your destination, some of which limit or exclude liability. Liability of Air Canada Vacations
Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising out of personal injury, accident or death, loss, damage, delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any of the following:

  • The act of omission of any third party including suppliers other than Air Canada Vacations or its employees;
  • Sickness, theft, labour dispute, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control;
  • Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you are not entitled to any refund);
  • Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in/checkout times;
  • Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or substitute travel services with a comparable alternative at our discretion, and Air Canada Vacations will advise you within a reasonable amount of time prior to departure of any such cancellation or change. If we must cancel your booking entirely, Air Canada Vacations' liability will be limited to a refund of all monies paid;
  • A full refund, however, will not be granted where cancellation of travel must be made by Air Canada Vacations for any situations which are unusual and/or unforeseeable, i.e., any Force Majeure including (but not limited to) weather conditions such as inundation, any type of storm, hurricane, twister or similar, fire, seismic activity, nuclear disasters, strikes, riots or civil conflicts, acts of war, terrorist actions, any public health emergencies or health risks, government actions, supplier bankruptcies and any other events beyond Air Canada Vacations' control. Air Canada Vacations is not liable for the costs or other consequences that arise out of or result from any inclement weather conditions at any time and where Air Canada Vacations' contractual obligations with its suppliers does not allow for reimbursement of the sums paid to the supplier on behalf of the customer.

All flights are operated by Air Canada or its Star Alliance partners or Air Canada Express (operated by Jazz Aviation LP) or Air Canada rouge, unless otherwise specified.

Credit Card Payments

Your use of your credit card number to apply full payment indicates your acceptance of and compliance with these booking Terms & Conditions, whether or not you have actually signed the appropriate credit card slip. Verbal authorization for the use of a credit card confirms the reservation. Air Canada Vacations reserves the right to cancel your booking if full payment is not received by the scheduled due date. Unless you or your travel agent is notified in writing that your booking has been automatically cancelled due to insufficient payment, your booking remains confirmed and full payment is due as per Air Canada Vacations' payment schedule outlined above.

Travel Documents

It is the passengers' responsibility to obtain information and to have in their possession all the required documentation to travel (such as passports, visa where applicable, etc.) required by the relevant governmental authorities. Failure to have proper travel documents will result in denied boarding and automatic cancellation of your reservation without refund. Electronic Ticketing

Air Canada Vacations uses electronic ticketing for the air/flight portion of your itinerary. Receipt of payment/booking confirmation is issued once payment has been received. Upon receipt of full payment and all applicable fees, electronic tickets will be issued between 30 and 14 days prior to departure. For reservations made 7 days or LESS prior to departure, electronic tickets will be made available within 24 to 48 hours. For reservations made on the day before departure, your travel documents will be issued within an hour of booking.

Change Fees

If you wish to make a change to a confirmed booking, the following charges will apply:
" 8 days or more prior to departure date: $75 per person. Accommodation and flight penalties may apply, as per exceptions below.
" 7 to 0 days prior to departure: 100% of the total price of your reservation.
" If a change is made to room occupancy and results in a higher rate, the remaining travellers are responsible for the rate applicable for the revised occupancy. Change requests cannot be made directly with any hotel or resort. Name change requests may be denied due to hotel- or airline-specific terms and conditions.
Exception: Train reservations: changes not permitted, full cancellation fees apply.

Guaranteed Departures

Certain guided tours are offered with guaranteed departure dates. Such guaranteed departures may occur only if a minimum number of participants have booked the same guided tours (the number may vary depending on the guided tour selected in order for Air Canada Vacations to offer them at the price indicated). If the minimum number of participants required for a guided tour with a guaranteed departure is not met, Air Canada Vacations may cancel the guided tour and offer the customer another guided tour or a full refund, the customer hereby renouncing to any recourse it may have against Air Canada Vacations as a result of this cancelation.

CANCELLATION FEES

Cancellation fees will apply as outlined below. Refunds for cancellation of a reservation will only be taken into consideration once notice is received in writing by Air Canada Vacations.

Standard Cancellation Policy

Air & Hotel packages, Air-inclusive tours, Fly & Drive tours, Air & Rail tours, Land tours, Air-inclusive Trafalgar Guided Vacations, Air-inclusive Contiki Guided Trips, Air only:

45 days or more prior to departure: $250 per person*.
44 to 22 days prior to departure: 50% non-refundable*.
21 days or less prior to departure: 100% non-refundable*.

*The total air costs are 100% non-refundable at all times for packages that include domestic flights, connecting flights, and flights operated by an air carrier other than Air Canada or Air Canada Rouge.

À la carte hotels:

15 days or more prior to departure: $100 fee per person*.
14 to 8 days prior to departure: 50% of total cost.
7 days or less prior to departure: 100% non-refundable.

Unless otherwise specified at time of booking non-refundable hotel rooms are 100% non-refundable.

Apartments and Apart'Hotels:

15 days or more prior to departure: 50% non-refundable.
14 days or less prior to departure: 100% non-refundable.

Excursions, à la carte visits, show tickets and travel insurance policies:

100% of total cost at all times.

Air Canada Vacations reserves the right to cancel your booking if full payment is not received by the scheduled due date. Unless you or your travel agent is notified in writing that your booking has been automatically cancelled due to insufficient payment, your booking remains confirmed and full payment is due as per Air Canada Vacations' payment schedule outlined above.

Full payment indicated above is per person in Canadian dollars and must be paid per passenger under the same reservation, including children and any additional guests.

Note: Additional amounts may be required for hotel, tour or airfare arrangements booked in conjunction with your cruise.

Cruise Line Passenger/Embarkation Form

In order to simplify the boarding process and to comply with international security laws, all travellers are required to complete a passenger immigration/embarkation form, found on each cruise lines' website well in advance of his/her sailing date. Travellers that do not complete the registration process at least seven (7) days prior to sail date will be required to be checked-in at the pier at least two (2) hours prior to the published sailing time or they will be subject to denied boarding with no refund. In addition, failure to properly complete the on-line registration form in a timely manner will result in delayed cruise tickets.

Vaccinations

Passengers are solely responsible for obtaining all required medical inoculations and appropriate certificates necessary for travel.

Minors

All cruise lines require individuals under the age of 21 to be accompanied by an adult of at least 21 years of age (ages 25+ for RCI, CEL, RSSC). This requirement is waived for married couples (proof of marriage is required) and minor children sailing with their parents or guardians in adjacent staterooms. The age of each individual on the date of sailing determines his/her status for the entire cruise. Age restrictions for alcohol consumption and gambling as well as infant and child rates and infant age restrictions vary by cruise line. Age requirements are subject to change. Please confirm at time of booking. Generally infants under six (6) months of age are not permitted to sail.

Special Needs

Any particular requirements (stateroom, airline and/or transfers) for passengers with special needs must be requested at time of booking. Most cruise lines have limited wheelchair-accessible staterooms for which a medical certificate is required to book. Passengers MUST provide this certificate to the cruise line at least 30 days BEFORE scheduled sailing. Any special transfer arrangements required may incur additional charges. Cruise passengers with special needs must be self-sufficient and accompanied by at least one other passenger who assumes full responsibility for their well being at all times. Passengers are advised to consult with an Air Canada Vacations cruise expert regarding the feasibility of managing certain itineraries. In certain cases, passengers in wheelchairs may be precluded from going ashore due to docking facilities. Please ensure your Air Canada Vacations cruise expert verifies all details concerning guests with physical challenges as cruise line policies are subject to change without prior notice.

Pregnancy

Pregnancy is considered a medical condition and you are required to disclose this to Air Canada Vacations at time of booking. Women having reached the late stage of their pregnancy (generally 24 weeks pregnant) will not be permitted to sail. A medical certificate may be required for women in their 23rd week or earlier who choose to sail. Details vary by cruise line and are always subject to change. Cruise line specific details will be provided at time of booking once we are notified of your condition.

Unfit for Travel

Air Canada Vacations and its cruise line partners reserve the right to decline any passenger at any time. Passengers may be declined or have their voyage terminated at their own risk and expense should their physical or mental condition, in the opinion of the ship's physician, render them unfit for travel, or represent a danger to themselves or any other passenger aboard the ship. Cruise lines also reserve the right to decline or terminate the voyage of any passenger who, at the sole discretion of the ship's captain, is believed to be dangerous to him/herself or others, or a cause of disturbance to cruise passengers or crew. Such passengers may be left at any scheduled port of call or place without any liability to the cruise line or Air Canada Vacations. In this circumstance, no refund or extra expenses will be honoured by the cruise line or Air Canada Vacations.

CRUISE TRAVEL DOCUMENTS

Cruise tickets: Cruise electronic tickets are issued between 21 and 14 days prior to departure. It is the full responsibility of all nationalities to obtain at their own expense, well in advance of the departure date, all necessary travel visas required by the relevant government authorities, including all the different ports of call, and to comply with the laws, thereof. Passports are required for Canadians travelling by air or by sea and the passport MUST be valid for six (6) months beyond the end date of your travel abroad. Failure to have the proper travel passports and visas will result in denied boarding and automatic cancellation of your cruise package without refund.

Some cruise itineraries require a travel visa in addition to a passport if you intend to disembark the ship on your own, without participating in an organized shore excursion purchased from the cruise lines. NOTE: Single parents must travel with a notarized letter of consent signed by the parent not travelling for presentation to the airline/cruise line without which the airline and/or cruise line reserve the right to deny boarding

OTHER TERMS & CONDITIONS FOR ANY EUROPE BOOKING

Insurance

Air Canada Vacations strongly recommends the purchase of an all-inclusive holiday insurance package (trip cancellation & interruption & classic medical travel insurance) offered by RBC Insurance or other sufficient traveller's insurance. Refunds

No reimbursements or refunds will be issued for unused travel services or any component of the package after departure. Refunds are not granted for bookings cancelled due to inclement weather or illness; these must be claimed through your travel insurance. No guarantee is provided or warranted that any refund will be available. No refund will be granted if a sale price is advertised after a reservation is confirmed.

Important: If the price of a product is displayed incorrectly at aircanadavacations.com, we reserve the right to cancel the reservation at the incorrect price within a reasonable delay and a refund of the monies will be processed immediately.

Reporting of Incidents

Regardless of Air Canada Vacations' liability, any incidents including injuries, service cancellation or problem, or dissatisfaction must be reported to your destination representative or Customer Care (telephone number and/or email address provided with travel documents) during the event or as soon as possible, to allow Air Canada Vacations an opportunity to provide assistance.

Validity of Rates

The package price is confirmed at time of booking. Air Canada Vacations endeavours to deliver the vacation package you have selected. If the price increased following the imposition of a surcharge on fuel by the carrier or an increase in the exchange rate, insofar as the exchange rate applicable before the date on which the services are provided has increased by more than 5% since the date on which the contract was entered into; and/or if the increase, without taking into account any increase in the provincial sales tax or Canada's goods and services tax, rising taxes, royalties or authorized charges by a competent public authority, is equal to or greater than 7% of the price of services, you may choose between a full and immediate reimbursement of the services or the provision of similar services. Reimbursements are processed by Air Canada Vacations within 14 days of receipt of your written request for cancellation.

Currency

All rates are quoted in Canadian funds, unless otherwise indicated based on exchange rates, fuel cost, taxes, fees, charges and surcharges (including service charges imposed by Air Canada Vacations) as confirmed at time of booking.

Prices DO NOT Include

Most holiday packages are subject to extra charges above those reflected in the price listed for each package. For example, any supplementary services purchased at destination (meals, drinks, cleaning, items listed in the facility description, etc.) in addition to any costs incurred en route to and/or from the destination, meals and/or alcoholic beverages (unless specified), local excursions at destination, telephone calls, tips, laundry, items of a personal nature and/or personal services not specified as being included in association with a selected product as per the product description in this site at aircanadavacations.com, are not included in Air Canada Vacations package prices.

For Quebec residents only, prices do not include the client contribution to the Indemnity Fund amounting to $1.00 per $1000 of travel services purchased, the amount of which will be added to the client's invoice.

If We Modify Your Booking

Sometimes, reserved accommodations may no longer be available for reasons such as unexpected maintenance or hotel overbooking. In such cases, substitute accommodation of equal or greater quality will be provided. If, after confirmation, Air Canada Vacations makes a hotel change or other changes to your travel arrangements such as:

" change of destination;
" change of departure or return by more than 24 hours;
" change of accommodation standards;
" change of the routing requiring additional travel identification or documentation without sufficient time to obtain this documentation before departure;

Then, Air Canada Vacations will contact you or your travel agent at the earliest convenience upon receipt of notification from the concerned supplier prior to your departure.

In this case, Air Canada Vacations offers the following options:

a. Acceptance of the change as offered;
b. Selection of an alternate package with Air Canada Vacations, based on availability. Any price differential resulting from substitution with a lower-priced alternative will be refunded. Customers are responsible for payment of any difference in price based on substitution of a higher priced alternative of their choice;
c. Cancellation of your vacation with a full refund of price paid to Air Canada Vacations.

Air Canada Vacations makes every effort to deal with the most reputable suppliers, we are not responsible for their acts and omissions and for acts and omissions of their respective employees, representatives or agents. Travel services are subject to conditions imposed by law and by third-party suppliers. As such, their liability is limited by their respective tariffs, conditions of carriage as well as international conventions and arrangements. Conditions of Carriage apply to flights bound to and from your destination, some of which limit or exclude liability. For air carrier liability and options available to you regarding loss, damage or delay of your baggage, consult aircanada.com and submit any claims directly to Air Canada or Air Canada Rouge.

Air Canada Vacations does not assume any responsibility for schedule changes made by the airline, or any additional costs (accommodation, meals, etc.) incurred due to any flight delays or missed connections. Additional hotelier terms and conditions may also apply.

Liability of Air Canada Vacations

Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising out of personal injury, accident or death, loss, damage, delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any of the following:
" The act of omission of any third party including suppliers other than Air Canada Vacations or its employees;
" Sickness, theft, labour dispute, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control;
" Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you are not entitled to any refund);
" Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in/checkout times;
" Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or substitute travel services with a comparable alternative at our discretion, and Air Canada Vacations will advise you within a reasonable amount of time prior to departure of any such a cancellation or change. If we must cancel your booking entirely, Air Canada Vacations' liability will be limited to a refund of all monies paid;
" A full refund, however, will not be granted where cancellation of travel must be made by Air Canada Vacations for any situations which are unusual and/or unforeseeable, i.e., any force majeure including (but not limited to) weather conditions such as inundation, any type of storm, hurricane, twister or similar, fire, seismic activity, nuclear disasters, strikes, riots or civil conflicts, acts of war, terrorist actions, any public health emergencies or health risks, government actions, supplier bankruptcies and any other events beyond Air Canada Vacations' control. Hurricane season in the North Atlantic is generally between June 1 and November 30. Air Canada Vacations is not liable for the costs or other consequences that arise out of or result from any inclement weather conditions at any time and where Air Canada Vacations' contractual obligations with its suppliers does not allow for reimbursement of the sums paid to the supplier on behalf of the customer.

All flights are operated by Air Canada or Air Canada Express (operated by Jazz Aviation LP), or Air Canada Rouge unless otherwise specified. Depending on the countries visited, flights can be operated by another carrier: via Air Canada to and from Lisbon, via TAP Portugal to and from Porto, via Air Canada to and from Frankfurt, via Lufthansa to and from Naples, via Air Canada to and from Athens, via Aegean Airlines or Sky Express to and from Mykonos, Santorini, Crete, and Rhodes, via Air Canada to and from Rome, via Alitalia from Catania. The carrier will be communicated to you before making your reservation and paying the deposit.

Air Canada Vacations reserves the right to decline any passenger at any time.

Hotel/Room Allocation

The hotel or resort is responsible for room allocation in accordance with the category reserved. Air Canada Vacations assumes no responsibility as to the location, décor, furnishing or type of bed in the room that may vary based on the room's location on the hotel property. If the customer would like to change rooms, such changes are subject to availability and additional fees may apply.

For all "Europe Your Way" travel packages, in addition to the above, the stipulation of "or similar" indicates that guests will stay at a hotel of the same star rating as the hotel listed. The hotel accommodations will be communicated to the consumer prior to departure.

When you book your travel at aircanadavacations.com you are added to our email list that will be used to contact you with offers that we feel will be of interest to you. If you do not want Air Canada Vacations to contact you with offers you may withdraw your consent at any time simply by changing your profile information and opting out. In addition, all emails sent to you by Air Canada Vacations contain simple instructions telling you how to "unsubscribe."

TERMS & CONDITIONS OF PAYMENT, CHANGES AND CANCELATION FEES FOR BOOKING AIR & HOTEL, AIR ONLY OR LAND ONLY PACKAGES:

Deposit, Final Payment & Cancellation charges “Payment schedule”

Full payment must be paid by credit card at time of booking. Air Canada Vacations reserves the right to cancel your booking if full payment is not received by the scheduled due date. Unless you or your travel agent is notified in writing that your booking has been automatically cancelled due to insufficient payment, your booking remains confirmed and full payment is due as per Air Canada Vacations' payment schedule outlined above.

Change Fees

Once final payment is received any changes or modifications to a file will incur an administration fee of $50. In addition to this fee, any changes or modification will be subject to all airline and supplier penalties and fees. Change fees of 100% of the total price of your booking will be applied if change is made within 7 days of departure. In addition, you assume responsibility for any such difference in price. Refunds will not be issued for any difference on a lower price alternative. If the change is made to room occupancy and results in a higher rate, the remaining travellers are responsible for the rate applicable for the revised occupancy. Change requests cannot be made directly with any hotel / resort, land operator or cruise company. Name change requests may be denied due to hotel, airline and / or cruise specific terms and conditions. Dates changes to a reservation will result in a cancellation with all applicable fees.

CANCELLATION FEES

Cancellation fees will apply as outlined below:

Refunds for cancellation of a reservation will only be taken into consideration once notice is received in writing at Air Canada Vacations.

Standard Cancellation Policy:

Air and hotel or Air only packages or hotel only packages. Excursions / day tours if applicable:
• 45 days or more prior to departure: $500 per person or 100% of total cost if value less than $500 per person
• 44- 22 days prior to departure: 50% of total price or 100% of total cost if value less than $500 per person
• 21-0 days prior to departure: 100% of total price**.

Cancellation fees are liquidated damages to compensate

TRAVEL DOCUMENTS

Air Canada Vacations uses electronic ticketing. Receipt of payment / booking confirmation is issued once payment has been received. Upon receipt of full payment and all applicable fees, electronic tickets will be issued between 30 and 14 days prior to departure. For reservations made 7 days or LESS prior to departure, electronic tickets will be made available within 24 to 48 hours.

• The act of omission of any third party including suppliers other than Air Canada Vacations or its employees;
• Sickness, theft, labour dispute, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control;
• Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you are not entitled to any refund);
• Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in / checkout times;
• Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or substitute travel services with a comparable alternative at our discretion and Air Canada Vacations will advise you within a reasonable amount of time prior to your departure of any such a cancelation or change. If we must cancel your booking entirely, Air Canada Vacations' liability will be limited to a refund of all monies paid.
• A full refund, however, will not be granted where cancellation of travel must be made by Air Canada Vacations for any situations which are unusual and / or unforeseeable, i.e., any force majeure including (but not limited to) weather conditions such as inundation, any type of storm, hurricane, twister or similar, fire, seismic activity, nuclear disasters, strikes, riots or civil conflicts, acts of war, terrorist actions, any public health emergencies or health risks, government actions, supplier bankruptcies and any other events beyond Air Canada Vacations control Air Canada Vacations is not liable for the costs or other consequences that arise out of or result from any inclement weather conditions at any time and where Air Canada Vacations' contractual obligations with its suppliers does not allow for reimbursement of the sums paid to the supplier on behalf of the customer.
All flights from and to Canada are operated by Air Canada and its Star Alliance partners or Air Canada Express (operated by Jazz Aviation LP), unless otherwise specified. Deposit and Final Payment (Payment Schedule)

Full payment must be paid by credit card at time of booking. Air Canada Vacations reserves the right to cancel your booking if full payment is not received by the scheduled due date. Unless you or your travel agent is notified in writing that your booking has been automatically cancelled due to insufficient payment, your booking remains confirmed and full payment is due as per Air Canada Vacations' payment schedule outlined above.

Credit Card Payments

Your use of your credit card number to apply deposit and final payment indicates your acceptance of and compliance with these booking Terms & Conditions, whether or not you have actually signed the appropriate credit card slip. Verbal authorization for the use of a credit card confirms the reservation. Air Canada Vacations reserves the right to cancel your booking if full payment is not received by the scheduled due date. Unless you or your travel agent is notified in writing that your booking has been automatically cancelled due to insufficient payment, your booking remains confirmed and full payment is due as per Air Canada Vacations' payment schedule outlined above.

Travel Documents

It is the passenger's responsibility to obtain information and to have in their possession all the required documentation to travel (such as passports, visa where applicable, etc.) required by the relevant governmental authorities. Failure to have proper travel documents will result in denied boarding and automatic cancellation of your reservation without refund. Electronic Ticketing

Air Canada Vacations uses electronic ticketing for the air/flight portion of your itinerary. Receipt of payment/booking confirmation is issued once payment has been received. Upon receipt of full payment and all applicable fees, electronic tickets will be issued between 30 and 14 days prior to departure. For reservations made 7 days or LESS prior to departure, electronic tickets will be made available within 24 to 48 hours. For reservations made on the day before departure, your travel documents will be issued within an hour of booking.

Change Fees

If you wish to make a change to a confirmed booking, it must be completed 45 days or MORE prior to departure. A change fee of $50 CAD per person plus GST applies per change. In addition, you assume responsibility for any such difference in price. Refunds will not be issued for any difference on a lower price alternative. If the change is made to room occupancy and results in a higher rate, the remaining travellers are responsible for the additional rate applicable for the revised occupancy. Change requests cannot be made directly with any hotel or resort. Name change requests may be denied due to hotel- or airline-specific terms and conditions. Changes made 44 days or LESS prior to departure are not accepted. Any changes, including name changes or corrections, you wish to make to a confirmed booking 44 days or LESS prior to departure will be treated as a cancellation. Cancellation fees will apply as outlined below. Refunds for cancellation of a reservation will only be taken into consideration once notice is received in writing by Air Canada Vacations. No refund will be granted if a sale price is advertised after a reservation is confirmed.

Standard Cancellation Policy

" 45 days or MORE prior to departure: $250 CAD per person*
" 44-21 days prior to departure: 50% of total price* (Air taxes are refundable)
" 20 days or LESS prior to departure: 100% non-refundable** (Air taxes are refundable)

*Cancellation fees are liquidated damages to compensate Air Canada Vacations for prepayments made on advance booking of travel services, and for administrative costs involved in processing a cancellation.

Insurance

Air Canada Vacations strongly recommends the purchase of an all-inclusive holiday insurance package (trip cancellation & interruption & classic medical travel insurance) offered by RBC Insurance or other sufficient traveller's insurance. Government health plans have severely cut back their coverage of out-of-country medical care. When travelling to Cuba, all travellers, foreign and Cubans living abroad, must have a medical insurance policy.

Refunds

No reimbursements or refunds will be issued for unused travel services or any component of the package after departure. Refunds are not granted for bookings cancelled due to inclement weather or illness; these must be claimed through your travel insurance. No guarantee is provided or warranted that any refund will be available. No refund will be granted if a sale price is advertised after a reservation is confirmed.

Important: If the price of a product is displayed incorrectly at aircanadavacations.com, we reserve the right to cancel the reservation at the incorrect price within a reasonable delay and a refund of the monies will be processed immediately.

Aeroplan® Miles: Aeroplan® Miles will not be restituted or refunded at any time.

Reporting of Incidents

Regardless of Air Canada Vacations' liability, any incidents including injuries, service cancellation or problem, or dissatisfaction must be reported to your destination representative or Customer Care (telephone number and/or email address provided with travel documents) during the event or as soon as possible, to allow Air Canada Vacations an opportunity to provide assistance.

GENERAL

Save $600 per Family

The package price is confirmed at time of booking and includes the reduction of the Save $600 per family on all Flight, Hotel & Transfer packages to ALL destinations in the Caribbean and Mexico of 7 nights or more. Air Canada Vacations will indicate the initial package price followed by the package price including the Save $600 per family. The Save $600 per family is in CAD, applicable to new bookings only booked between July 4 and September 9, 2018. Valid for departures between November 1, 2018 and April 30, 2019 and is based on a family of 2 adults and 2 children (ages 212) and a savings of $200 per adult and $100 per child. This offer cannot be combined with any other offer, except for discounts offered by hotels and resorts and the 8 free days of airport parking offered by Air Canada Vacations as described below. Air Canada Vacations reserves the right to limit this offer. Certain blackout periods apply and are indicated at aircanadavacations.com. CareFlex

Must be purchased at time of booking and for all passengers sharing the same room. Applicable to new bookings only. Valid only on vacation packages to: Cuba (excluding Havana), Dominican Republic, Mexico (excluding Mexico City), Montego Bay, Saint Lucia, Antigua, Curaçao, Grenada, Great Exuma, St. Kitts, Cartagena, Liberia. CareFlex plan can be used year-round except during the blackout period from December 19 to January 5. Validity of Rates

The package price is confirmed at time of booking. Air Canada Vacations endeavours to deliver the vacation package you have selected. If the price increased following the imposition of a surcharge on fuel by the carrier or an increase in the exchange rate, insofar as the exchange rate applicable before the date on which the services are provided has increased by more than 5% since the date on which the contract was entered into; and/or if the increase, without taking into account any increase in the provincial sales tax or Canada's goods and services tax, rising taxes, royalties or authorized charges by a competent public authority, is equal to or greater than 7% of the price of services, you may choose between a full and immediate reimbursement of the services or the provision of similar services. Reimbursements are processed by Air Canada Vacations within 14 days of receipt of your written request for cancellation.

Currency

All rates are quoted in Canadian funds, unless otherwise indicated based on exchange rates, fuel costs, taxes, fees, charges and surcharges (including service charges imposed by Air Canada Vacations) as confirmed at time of booking.

INCLUSIONS AND EXCLUSIONS

Prices DO Include:
Selected combination of flights, accommodation, airport-hotel transfers (not including surcharge for transfer of sports equipment) at destination except for San Juan (Puerto Rico), Hawaii, California, Las Vegas, Belize, Bermuda, Grand Cayman, St. Vincent and the Grenadines, Cruises, Florida except Disney packages, applicable taxes (except the departure tax in Belize of US$25, which is paid locally), fees, charges and surcharges (including service charges imposed by Air Canada Vacations) and any other inclusions as specified for product selected as per the resort description on aircanadavacations.com.

Exceptions:

" Ultimate Escapes collection: Private airport-hotel transfers are included for all destinations except Las Vegas and Hawaii.

" Room levy in Barbados: a mandatory Room Rate Levy' applies per room, per night, based on the rating/ranking from the Barbados Hotel and Tourism Association (BHTA), as follows: Luxury hotels: US$10.00; A class hotels: US$5.50; B class & apartment hotels: US$2.50. Total levy to be paid at destination upon departure. Your resort will confirm the nightly amount.

" Colombia entry tax: Canadians between the ages of 14 and 79 are required to pay a tax of approximately $85US to enter Colombia, in cash or by credit or debit card upon entry into the country. You will be issued a platinum card (Tiquete Platinum). Customs procedures may be delayed by the processing of payment of the tax. You must keep the platinum card for the duration of your stay in Colombia and show the card upon departure from Colombia. Canadians travelling only to the archipelago of San Andrés, Providencia and Santa Catalina are exempt from the entry tax. Consult Migración Colombia (in Spanish), the country's immigration department, for more information.

Prices DO NOT Include:

Most vacation packages are subject to extra charges above those reflected in the price for each package. For example, any supplementary services purchased at destination (meals, drinks, cleaning, items listed in the facilities description, etc.) in addition to any costs incurred en route to and/or from the destination, meals and/or alcoholic beverages (unless specified), local excursions at destination, telephone calls, tips, laundry, items of a personal nature and/or personal services not specified as being included in association with a selected product as per the resort description on this site at aircanadavacations.com, are not included in Air Canada Vacations package prices.

Rates do not include transfers in San Juan (Puerto Rico), Hawaii, California, Las Vegas, Belize, Bermuda, Grand Cayman, St. Vincent and the Grenadines, cruises, and Florida (except for Disney packages).

Rates do not include any additional fees that may apply for sports equipment aboard a transfer vehicle, which is to be paid at destination.

Rates do not include the tax to enter Colombia whereby Canadians between the ages of 14 and 79 are required to pay a tax of approximately $85US to enter Colombia in cash or by credit or debit card upon entry into the country. You will be issued a platinum card (Tiquete Platinum). Customs procedures may be delayed by the processing of payment of the tax. You must keep the platinum card for the duration of your stay in Colombia and show the card upon departure from Colombia. For Quebec residents only: Prices do not include the client contribution to the Indemnity Fund amounting to $1.00 per $1000 of travel services purchased, the amount of which will be added to the client's invoice. The Indemnity Fund is regulated by the Quebec Consumer Protection Office and is subject to change without notice.

Ultimate Escapes collection: Certain hotels may offer internal promotions that are not included in your Air Canada Vacations package, such as, but not limited to, complimentary rounds of golf (mandatory cart rental and other extras not included); and in-suite champagne breakfast for honeymooners (marriage certificate required).

If We Modify Your Booking

Sometimes, reserved accommodations may no longer be available for reasons such as unexpected maintenance or hotel overbooking. In such cases, substitute accommodation of equal or greater quality will be provided. If, after confirmation, Air Canada Vacations makes a hotel change or other changes to your travel arrangements such as:
" change of destination;
" change of departure or return by more than 24 hours;
" change of accommodation standards;
" change of the routing requiring additional travel identification or documentation without sufficient time to obtain this documentation before departure;

then Air Canada Vacations will contact you or your travel agent at the earliest convenience upon receipt of notification from the concerned supplier prior to your departure. In this case, Air Canada Vacations offers the following options:
a. Acceptance of the change as offered;
b. Selection of an alternate package with Air Canada Vacations, based on availability. Any price differential resulting from substitution with a lower-priced alternative will be refunded. Customers are responsible for payment of any difference in price based on substitution of a higher priced alternative of their choice;
c. Cancellation of your vacation with a full refund of the price paid to Air Canada Vacations.

HOTEL DESCRIPTIONS

All hotel descriptions on this site are accurate at time of posting. For reasons beyond Air Canada Vacations' control, changes that affect hotel descriptions may occur. Any modification will be updated on aircanadavacations.com, and will be communicated at time of booking. In the event of any discrepancy between information in the brochure and our website, the information on our website shall prevail.

LIABILITY

Liability of Suppliers

Air Canada Vacations makes arrangements with third-party suppliers who provide travel services such as flights, cruises, hotels, airport-hotel transfers, sightseeing excursions, car rentals or other activities included in your package.

Air Canada Vacations makes every effort to deal with the most reputable suppliers; we are not responsible for their acts and omissions and for acts and omissions of their respective employees, representatives or agents.

Excursions

Customers may choose to participate in excursions, optional tours or activities that may be offered for an additional fee by Air Canada Vacations on behalf of local suppliers at destinations. Any written or oral contract is considered to be exclusively between the customer and the supplier. Some excursions may have a risk of personal injury, loss or damage. Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising from a customer's participation in said excursions.

Airline

Travel services are subject to conditions imposed by law and by third-party suppliers. As such, their liability is limited by their respective tariffs, conditions of carriage as well as international conventions and arrangements. Conditions of Carriage apply to flights bound to and from your destination, some of which limit or exclude liability. For air carrier liability and options available to you regarding loss, damage or delay of your baggage, please consult the Air Canada website and submit any claims directly to Air Canada. Air Canada Vacations does not assume any responsibility for schedule changes made by the airline, or any additional costs (accommodation, meals, etc.) incurred due to any flight delays or missed connections.

All flights are operated by Air Canada, Air Canada Rouge or Air Canada Express (operated by either Jazz Aviation LP, Sky Regional, Air Georgian or EVAS-Exploits Valley Services), unless otherwise specified.

Air Canada Vacations reserves the right to decline any passenger at any time.

Airport Check-in

It is recommended that customers present themselves at the airport counter of the airline indicated on their voucher 3 hours prior to departure, and must follow the check-in and boarding gate deadlines listed on the Air Canada website.

Air Canada representatives are available to assist you while at the airport, or you may contact an Air Canada Vacations representative at 1-800-296-3408. Failure to check-in and board on time may result in the cancellation of a customer's reservation with no right of recourse or refund.

Minors - Flight Portion

Infants under 2 years of age (at date of completion of travel) travel for a reduced rate aboard Air Canada. Only one infant is permitted per adult passenger (16 years of age or older). Reduced rates are also available for children between 2 and 12 years old.

Food, Water and Beverages

Change of routine, sun and/or food, water and beverages may be very different in other countries and may lead to health issues or illness. Customers are encouraged to take all necessary precautions. Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising from these conditions and resulting health issues. Water interruptions/power outages may be experienced at times.

Social and Sports Activities

Many resorts include social activities, organized sports, and use of sports equipment as part of their services. These amenities are subject to change or cancellation at any time without notice. Some activities may involve risks.

Insects

Insects may be found inside and outside of the hotel no matter the hotel chosen as part of the vacation package. Customers are encouraged to take all necessary precautions.

Holidays, School Breaks, Elections and Conventions

Availability of some services and amenities may be limited during certain periods. These periods may include but are not limited to school breaks, spring breaks, religious holidays, elections and conventions. These periods vary by country and are controlled by local or particular authorities.

Air Canada Vacations assumes no responsibility for inconveniences customers may experience when travelling during one of these periods.

Room Allocation

The hotel or resort is responsible for room allocation in accordance with the category reserved.

Air Canada Vacations assumes no responsibility as to location, décor, furnishing or type of bed in the room that may vary based on the room's location on the hotel property. If the customer would like to change rooms, the Air Canada Vacations representative at destination, where applicable, can assist. Check-in and Check-out Conditions

Hotel check-in is generally between noon and 3 p.m. Hotel check-out times may vary depending on the property but generally customers must vacate the room by 11 a.m. For passengers with late flights, every effort will be made to provide a hospitality room, however, this cannot be guaranteed, particularly during high season. Customers will only have access to meals and drinks included in their package between the time they check-in and the time they check-out.

Luggage

You can take one carry-on bag and one personal item on the flight. Excess baggage or sports equipment may incur additional charges. For up-to-date information on dimensions, weight allowances, checked luggage, excess baggage and sports equipment, please visit Air Canada's Baggage Information page.

It is a good idea to purchase baggage insurance at time of booking.

Transfers

Travel times from the airport to your hotel as indicated on this site are approximate and can vary due to unforeseen circumstances.

Views

Oceanfront rooms offer direct views of the ocean. Ocean view rooms offer partial views of the ocean or views from an angle.

Intermediate Season

From May to November, some services and facilities at hotels may be suspended or offered in rotation.

Beaches

Please note that the size and condition of beaches can vary without notice due to various environmental factors, including adverse weather.

CUSTOMER RESPONSIBILITY

Special Needs

Any particular requirements for passengers with special needs must be requested at time of booking. Some circumstances and medical conditions require that customers provide advance notice and receive medical approval for air travel (for more information, visit the Air Canada website). Adapted transport for transfer at destination is at extra cost when available. Certain activities at the hotels may be inaccessible to persons of reduced mobility.

Statement to the Travel Agent

Customers must inform their travel agents of their intentions, expectations and needs before their travel reservations are completed.

Medication

It is the customer's responsibility to have all necessary medications and to carry them in their hand luggage at all times and to refer to the Air Canada website for required policy to transport prescribed medication. It is the customer's responsibility to ensure that they are fit to travel, and that they have consulted a qualified medical professional.

Pregnancy

You are required to disclose pregnancy to Air Canada Vacations at time of booking. Any woman with a normal pregnancy and no previous history of premature labour may travel up to and including her 36th week on Air Canada , Air Canada Express (operated by Jazz Aviation LP, Sky Regional, Air Georgian or EVAS-Exploits Valley Services) or Air Canada Rouge.

Sports and Activities

Information regarding sports and activities on this site is for information purposes only and is not meant to incite participation. Air Canada Vacations assumes no responsibility for any accident, damage, cost or expense arising from participation.

Written notice of any claim against Air Canada Vacations must be addressed as indicated below and received by our offices no later than 14 days upon return from your trip.

TERMS & CONDITIONS OF PAYMENT, CHANGES AND CANCELATION FEES FOR BOOKING AIR & HOTEL, AIR ONLY OR LAND ONLY PACKAGES:

Deposit, Final Payment & Cancellation charges “Payment schedule”

Full payment must be paid by credit card at time of booking. Air Canada Vacations reserves the right to cancel your booking if full payment is not received by the scheduled due date. Unless you or your travel agent is notified in writing that your booking has been automatically cancelled due to insufficient payment, your booking remains confirmed and full payment is due as per Air Canada Vacations' payment schedule outlined above.

Change Fees

Once final payment is received any changes or modifications to a file will incur an administration fee of $50. In addition to this fee, any changes or modification will be subject to all airline and supplier penalties and fees. Change fees of 100% of the total price of your booking will be applied if change is made within 7 days of departure. In addition, you assume responsibility for any such difference in price. Refunds will not be issued for any difference on a lower price alternative. If the change is made to room occupancy and results in a higher rate, the remaining travellers are responsible for the rate applicable for the revised occupancy. Change requests cannot be made directly with any hotel / resort, land operator or cruise company. Name change requests may be denied due to hotel, airline and / or cruise specific terms and conditions. Dates changes to a reservation will result in a cancellation with all applicable fees.

CANCELLATION FEES

Cancellation fees will apply as outlined below:

Refunds for cancellation of a reservation will only be taken into consideration once notice is received in writing at Air Canada Vacations.

Standard Cancellation Policy:

Air and hotel or Air only packages or hotel only packages. Excursions / day tours if applicable:
• 45 days or more prior to departure: $500 per person or 100% of total cost if value less than $500 per person
• 44- 22 days prior to departure: 50% of total price or 100% of total cost if value less than $500 per person
• 21-0 days prior to departure: 100% of total price**.

Cancellation fees are liquidated damages to compensate

Air Canada Vacations for prepayments made on advance booking of travel services, and for administrative costs involved in processing a cancellation

TRAVEL DOCUMENTS

Air Canada Vacations uses electronic ticketing. Receipt of payment / booking confirmation is issued once payment has been received. Upon receipt of full payment and all applicable fees, electronic tickets will be issued between 30 and 14 days prior to departure. For reservations made 7 days or LESS prior to departure, electronic tickets will be made available within 24 to 48 hours.

OTHER TERMS & CONDITIONS FOR ANY BOOKING:

Refunds

No reimbursements or refunds will be issued for unused travel services or any component of the package after departure. Refunds are not granted for bookings cancelled due to inclement weather or illness; these must be claimed through your travel insurance. No guarantee is provided or warranted that any refund will be available. No refunds will be granted if a sale price is advertised after a reservation is confirmed.

Important: If the price of a product is displayed incorrectly at aircanadavacations.com, we reserve the right to cancel the reservation at the incorrect price within a reasonable delay and a refund of the monies will be processed immediately.

Reporting of Incidents

Regardless of Air Canada Vacations liability, any incidents including injuries, service cancellation or problem, or dissatisfaction must be reported to Customer Care (telephone number with travel documents) during the event or as soon as possible to allow Air Canada Vacations an opportunity to provide assistance. -If you are on a cruise, please report to the Purser's Office while you are on board, they will make every effort to resolve it.

GENERAL

Validity of Rates

Prices displayed in this site are the lowest available at time of posting, and apply to a specific date. Air Canada Vacations endeavours to deliver the vacation package you have selected. If the price increased following the imposition of a surcharge on fuel by the carrier or an increase in the exchange rate, insofar as the exchange rate before the date on which the services are provided has increased by more than 5% since the date on which the contract was entered into; and / or if the increase, without taking into account any increase in the Québec sales tax or Canada's goods and services tax, is equal to or greater than 7% of the price of services, the customer may choose between full and immediate reimbursement of the services or the provision of similar services; Refunds are processed by Air Canada Vacations within 14 days of receipt of your written request for cancellation.

Currency

All rates are quoted in Canadian funds, unless otherwise indicated based on exchange rates, fuel cost, taxes, fees, charges and surcharges (including services charges imposed by Air Canada Vacations) valid at time of posting.

INCLUSIONS AND EXCLUSIONS

Prices DO Include

Selected combination of flights, accommodation, transfers at destination when applicable, applicable taxes, fees, charges and surcharges (including services charges imposed by Air Canada Vacations) and any other inclusions as specified for product selected as per the description in this site aircanadavacations.com.

Prices DO NOT Include

Most holiday packages are subject to extra charges above those reflected in the price listed for each package. For example, any supplementary services purchased at destination (meals, drinks, cleaning, items listed in the facility description etc.) in addition to any costs incurred en route to and / or from the destination, meals and / or alcoholic beverages (unless specified), local excursions at destination, telephone calls, tips, laundry, items of a personal nature and / or personal services not specified as being included in association with a selected product as per the resort description on aircanadavacations.com, are not included in Air Canada Vacations package prices. For Quebec residents only, prices do not include the client contribution to the Indemnity Fund amounting to $1.00 per $1000 of travel services purchased, the amount of which will be added to the client's invoice.

If We Modify Your Booking

Sometimes, reserved accommodations may no longer available for reasons such as unexpected maintenance or hotel overbooking. In such cases, substitute accommodation of equal or greater quality will be provided. If, after confirmation, a hotel change or other changes to your travel arrangements such as:
• change of destination;
• change of departure or return by more than 16 hours;
• change of accommodation standards;
• change of the routing requiring additional travel identification or documentation without sufficient time to obtain this documentation before departure.
Then Air Canada Vacations will contact you or your travel agent at the earliest convenience upon receipt of notification from the concerned supplier prior to your departure. In this case, Air Canada Vacations offers the following options:
a. Acceptance of the change as offered;
b. Selection of an alternate package with Air Canada Vacations, based on availability. Any price differential resulting from substitution with a lower-priced alternative will be refunded. Customers are responsible for payment of any difference in price based on substitution of a higher-priced alternative of their choice;
c. Cancellation of your vacation with a full refund of price paid to Air Canada Vacations

HOTEL/SHIP DESCRIPTION

All descriptions in this site are accurate at time of posting. For reasons beyond Air Canada Vacations' control, changes which may affect hotels' or cruises' or tours' description may occur. Any modification will be updated on Air Canada Vacations' website and will be communicated at time of booking.

LIABILITY

Liability of Suppliers

Air Canada Vacations makes arrangements with third-party suppliers who provide travel services such as flights, cruises, hotels, airport-hotel transfers, sightseeing, car rental or other activities included in your package. Air Canada Vacations makes every effort to deal with the most reputable suppliers; we are not responsible for their acts and omissions and for acts and omissions of their respective employees, representatives or agents. Travel services are subject to conditions imposed by law and by third-party suppliers. As such, their liability is limited by their respective tariffs, conditions of carriage as well as international conventions and arrangements. Conditions of Carriage apply to flights bound to and from your destination, some of which limit or exclude liability. For air carrier liability and options available to you regarding loss, damage or delay of your baggage, consult aircanada.com and submit any claims directly to Air Canada. Air Canada Vacations does not assume any responsibility for schedule changes made by the airline, or any additional costs (accommodation, meals, etc.) incurred due to any flight delays or missed connections. Additional hotelier terms and conditions may also apply.

Liability of Air Canada Vacations

Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising out of personal injury, accident or death, loss, damage, delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any of the following:
• The act of omission of any third party including suppliers other than Air Canada Vacations or its employees;
• Sickness, theft, labour dispute, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control;
• Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you are not entitled to any refund);
• Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in / checkout times;
• Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or substitute travel services with a comparable alternative at our discretion and Air Canada Vacations will advise you within a reasonable amount of time prior to your departure of any such a cancelation or change. If we must cancel your booking entirely, Air Canada Vacations' liability will be limited to a refund of all monies paid.
• A full refund, however, will not be granted where cancellation of travel must be made by Air Canada Vacations for any situations which are unusual and / or unforeseeable, i.e., any force majeure including (but not limited to) weather conditions such as inundation, any type of storm, hurricane, twister or similar, fire, seismic activity, nuclear disasters, strikes, riots or civil conflicts, acts of war, terrorist actions, any public health emergencies or health risks, government actions, supplier bankruptcies and any other events beyond Air Canada Vacations control Air Canada Vacations is not liable for the costs or other consequences that arise out of or result from any inclement weather conditions at any time and where Air Canada Vacations' contractual obligations with its suppliers does not allow for reimbursement of the sums paid to the supplier on behalf of the customer.

If the change is made to room occupancy and results in a higher rate, the remaining travellers are responsible for the additional rate applicable for the revised occupancy. Change requests cannot be made directly with any hotel or resort. Name change requests may be denied due to hotel- or airline-specific terms and conditions. Changes made 6 days or LESS prior to departure are not accepted. Any changes, including name changes or corrections, you wish to make to a confirmed booking 7 days or LESS prior to departure will be treated as a cancellation. Fly & Drive:

Conditions of car rental included with Fly & Drive:

Daily rate is based on 24 hours.

Clients will be charged directly for additional hours, days and any additional coverage or optional products purchased at the commencement of the rental.

Minimum rental period is 48 hours.

Rates are based on pick up date and not return date.

An honoured credit card may be required at time of checkout for any other charges not included in the voucher, e.g., gasoline, Loss Damage Waiver, Personal Accident Insurance, one way service fees and taxes.

Minimum age for car rental is 21 with a prepaid voucher. A valid driver's license from country of origin must be presented at time of rental. All drivers under the age of 25 will be subject to a surcharge of CA$25.00 per day; subject to change

Certain car classes may not be available to drivers under age 25.

Certain locations and classes of car require 3 forms of identification as a condition to rent.

Additional authorized drivers - including spouses and partners - must be registered on the rental agreement. Additional driver fee is CA$10.00 per day per additional driver up to a max of CA$50.00 per rental, per driver, where applicable; subject to change. All additional drivers should hold an honoured charge card and must possess a valid driver's license.

One-way rentals are available and are subject to applicable one-way service fees. One-way rentals are subject to availability. One-way fees are determined by distance between stations.

Guaranteed drop charges are paid locally by clients directly. This charge will be held against the customer's credit card but will not be charged to the card until the completion of the rental. These charges are subject to applicable taxes and surcharges.

One-way rentals into the US are not allowed.

Vehicles can be driven into the USA but not Mexico. This may vary by location, where applicable.

Vehicles come with a full tank of gas at time of rental.

Rates do not include fuel unless specifically indicated.

The renter is responsible for refuelling at the end of the rental if the Fuel Purchase Option is not purchased by the client at time of rental or included in the net rates. Gasoline refueling charges will vary by region and fluctuate according to market conditions dictating the cost of fuel.

There is no credit for remaining fuel.

Some optional products, such as child seat, skierized vehicle, garmin GPS, unit, may be available at a fee.

GENERAL

Insurance

Air Canada Vacations strongly recommends the purchase of an all-inclusive holiday insurance package (trip cancellation & interruption & classic medical travel insurance) offered by RBC Insurance or other sufficient traveller's insurance. Refunds

No reimbursements or refunds will be issued for unused travel services or any component of the package after departure. Refunds are not granted for bookings cancelled due to inclement weather or illness; these must be claimed through your travel insurance. No guarantee is provided or warranted that any refund will be available. No refund will be granted if a sale price is advertised after a reservation is confirmed.

Important: If the price of a product is displayed incorrectly at aircanadavacations.com, we reserve the right to cancel the reservation at the incorrect price within a reasonable delay and a refund of the monies will be processed immediately.

Reporting of Incidents

Regardless of Air Canada Vacations liability, any incidents including injuries, service cancellation or problem, or dissatisfaction must be reported to Customer Care (telephone number with travel documents) during the event or as soon as possible, to allow Air Canada Vacations an opportunity to provide assistance.

Air Canada Vacations email offers

When you book your travel at aircanadavacations.com you are added to our email list that will be used to contact you monthly with offers that we feel will be of interest to you. If you do not want Air Canada Vacations to contact you with offers you may withdraw your consent at any time simply by changing your profile information and opting out. In addition, all emails sent to you by Air Canada Vacations contain simple instructions telling you how to "unsubscribe."

Validity of Rates

The price for any booking is confirmed at time of the call. After the booking is confirmed, if the price increased following the imposition of a surcharge on fuel by the carrier or an increase in the exchange rate, insofar as the exchange rate applicable before the date on which the services are provided has increased by more than 5% since the date on which the contract was entered into; and/or if the increase, without taking into account any increase in the provincial sales tax or Canada's goods and services tax, rising taxes, royalties or authorized charges by a competent public authority, is equal to or greater than 7% of the price of services, you may choose between a full and immediate reimbursement of the services or the provision of similar services. Refunds are processed by Air Canada Vacations within 14 days of receipt of your written request for cancellation.

Currency

All rates are quoted in Canadian funds, unless otherwise indicated based on exchange rates, fuel cost, taxes, fees, charges and surcharges (including service charges imposed by Air Canada Vacations) as confirmed at time of booking.

INCLUSIONS AND EXCLUSIONS

Prices DO Include:

Selected combination of flights, accommodation, cruise ship, excursions, multi-day tour itineraries, guided tours, escorted tours, railways, coach buses or other suppliers associated with the assembly of your package or other type of packages, applicable taxes, fees, charges and surcharges (including service charges imposed by Air Canada Vacations) and any other inclusions as specified for product selected in the sitee and the description at aircanadavacations.com.

Prices DO NOT Include:

Most holiday packages are subject to extra charges above those reflected in the price for each package. For example, any supplementary services purchased at destination (meals, drinks, cleaning, items listed in the facilities description etc.) in addition to any costs incurred en route to and/or from the destination, meals and/or alcoholic beverages (unless specified), local excursions at destination, telephone calls, tips, laundry, car rental insurances and taxes and fees billed at destination by the car rental company when booking a car rental, items of a personal nature and/or personal services not specified as being included in association with a selected product as per the resort description in this site at aircanadavacations.com, are not included in Air Canada Vacations package prices.

For Quebec residents only, prices do not include the client contribution to the Indemnity Fund amounting to $1.00 per $1000 of travel services purchased, the amount of which will be added to the client's invoice.

If We Modify Your Booking

Sometimes, reserved accommodations may no longer be available for reasons such as unexpected maintenance or hotel overbooking. In such cases, substitute accommodation of equal or greater quality will be provided. If, after confirmation, Air Canada Vacations makes a hotel change or other changes to your travel arrangements such as:
• change of destination;
• change of departure or return by more than 24 hours;
• change of accommodation standards;
• change of the routing requiring additional travel identification or documentation without sufficient time to obtain this documentation before departure; then Air Canada Vacations will contact you or your travel agent at the earliest convenience upon receipt of notification from the concerned supplier prior to your departure. In this case, Air Canada Vacations offers the following options:
a. Acceptance of the change as offered;
b.Selection of an alternate package with Air Canada Vacations, based on availability. Any price differential resulting from substitution with a lower-priced alternative will be refunded. Customers are responsible for payment of any difference in price based on substitution of a higher priced alternative of their choice;
c.Cancellation of your vacation with a full refund of the price paid to Air Canada Vacations.

LIABILITY

Liability of Suppliers

Air Canada Vacations makes arrangements with third-party suppliers who provide travel services such as flights, cruises, hotels, airport-hotel transfers, sightseeing excursions, multi-day tour itineraries, guided tours, escorted tours, railways, coach buses, car rentals or other activities included in your package. Air Canada Vacations makes every effort to deal with the most reputable suppliers; we are not responsible for their acts and omissions and for acts and omissions of their respective employees, representatives or agents.

Excursions

Customers may choose to participate in excursions, optional tours or activities that may be offered for an additional fee by Air Canada Vacations on behalf of local suppliers at destinations. Any written or oral contract is considered to be exclusively between the customer and the supplier. Some excursions may have a risk of personal injury, loss or damage. Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising from a customer's participation in said excursions.

Airline

Travel services are subject to conditions imposed by law and by third-party suppliers. As such, their liability is limited by their respective tariffs, conditions of carriage as well as international conventions and arrangements. Conditions of Carriage apply to flights bound to and from your destination, some of which limit or exclude liability. For air carrier liability and options available to you regarding loss, damage or delay of your baggage, please consult aircanada.com and submit any claims directly to Air Canada. Air Canada Vacations does not assume any responsibility for schedule changes made by the airline, or any additional costs (accommodation, meals, etc.) incurred due to any flight delays or missed connections.

Liability of Air Canada Vacations

Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising out of personal injury, accident or death, loss, damage, delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any of the following:
• The act or omission of any third party including suppliers other than Air Canada Vacations or its employees;
• Sickness, theft, labour dispute, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control;
• Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you are not entitled to any refund);
• Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in / checkout times;
• Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or substitute travel services with a comparable alternative at our discretion, and Air Canada Vacations will advise you within a reasonable amount of time prior to departure of any such cancellation or change. If we must cancel your booking entirely, Air Canada Vacations' liability will be limited to a refund of all monies paid;
• A full refund, however, will not be granted where cancellation of travel must be made by Air Canada Vacations for any situations which are unusual and/or unforeseeable, i.e., any force majeure including (but not limited to) weather conditions such as inundation, any type of storm, hurricane, tornado or similar, fire, seismic activity, nuclear disasters, strikes, riots or civil conflicts, acts of war, terrorist actions, any public health emergencies or health risks, government actions, supplier bankruptcies and any other events beyond Air Canada Vacations' control.

Hurricane season in the North Atlantic is generally between June 1 and November 30. Air Canada Vacations is not liable for the costs or other consequences that arise out of or result from any inclement weather conditions at any time and where Air Canada Vacations' contractual obligations with its suppliers does not allow for reimbursement of the sums paid to the supplier on behalf of the customer.

All flights are operated by Air Canada, Air Canada Rouge or Air Canada Express (operated by either Jazz Aviation LP, Sky Regional, Air Georgian or EVAS-Exploits Valley Services), unless otherwise specified.

Air Canada Vacations reserves the right to decline any passenger at any time.

OTHER IMPORTANT INFORMATION

Airport Check-in

It is recommended that customers present themselves at the airport counter of the airline indicated on their voucher 3 hours prior to departure, and must follow the check-in and boarding gate deadlines listed on aircanada.com.

Air Canada representatives are available to assist you while at the airport, or you may contact an Air Canada Vacations representative at 1-800-296-3408. Failure to check-in and board on time may result in the cancellation of a customer's reservation with no right of recourse or refund.

Minors - Flight Portion

Infants under 2 years of age (at date of completion of travel) travel for a reduced rate aboard Air Canada. Only one infant is permitted per adult passenger (16 years of age or older). Reduced rates are also available for children between 2 and 12 years old.

Food, Water and Beverages

Change of routine, climate conditions and/or food, water and beverages may lead to health issues or illness. Customers are encouraged to take all necessary precautions. Air Canada Vacations assumes no responsibility for any claim, loss, damage, cost or expense arising from these conditions and resulting health issues. Water interruptions/power outages may be experienced at times.

Social and Sports Activities

Resorts may include social activities, sports, and use of sports equipment as part of their services. These amenities are subject to change or cancellation at any time without notice. Some activities may involve risks.

Insects

Insects may be found inside and outside of the hotel no matter the hotel chosen as part of the vacation package. Customers are encouraged to take all necessary precautions.

Holidays, School Breaks, Elections and Conventions

Availability of some services and amenities may be limited during certain periods. These periods may include but are not limited to school breaks, spring breaks, religious holidays, elections and conventions. These periods vary by province and are controlled by local or particular authorities.

Air Canada Vacations assumes no responsibility for inconveniences customers may experience when travelling during one of these periods.

Room Allocation

The hotel or resort is responsible for room allocation in accordance with the category reserved. Air Canada Vacations assumes no responsibility as to location, décor, furnishing or type of bed in the room that may vary based on the room's location on the hotel property.

Check-in and Checkout Conditions

Hotel check-in is generally between noon and 3 p.m. Hotel checkout times may vary depending on the property but generally customers must vacate the room by 11 a.m. For passengers with late flights, every effort will be made to provide a hospitality room, however, this cannot be guaranteed, particularly during high season.

Luggage

You can take one carry-on bag and one personal item on the flight.

Transfers

Travel times from the airport to your hotel in this site are approximate and can vary due to unforeseen circumstances.

CUSTOMER RESPONSIBILITY

Special Needs

Any particular requirements for passengers with special needs must be requested at time of booking. Some circumstances and medical conditions require that customers provide advance notice and receive medical approval for air travel (for more information, visit aircanada.com). Adapted transport for transfer at destination is at extra cost when available. Certain activities at the hotels may be inaccessible to persons of reduced mobility.

Statement to the Travel Agent

Customers must inform their travel agents of their intentions, expectations and needs before their travel reservations are completed.

Medication

It is the customers' responsibility to have all necessary medications and to carry them in their hand luggage at all times and to refer to aircanada.com for required policy to transport prescribed medication. It is the customers' responsibility to ensure that they are fit to travel, and that they have consulted a qualified medical professional.

Pregnancy

You are required to disclose pregnancy to Air Canada Vacations at time of booking. Any woman with a normal pregnancy and no previous history of premature labour may travel up to and including her 36th week on Air Canada, Air Canada Express (operated by Jazz Aviation LP, Sky Regional, Air Georgian or EVAS-Exploits Valley Services) or Air Canada Rouge.

Sports and Activities

Information regarding sports and activities in this site is for information purposes only and is not meant to incite participation. Air Canada Vacations assumes no responsibility for any accident, damage, cost or expense arising from participation.

Air Canada Vacations will do its best to monitor any construction and readiness; it does not have control over this.
